Partner Program Agreement

This agreement is between SPAIN AT HOME SHOP LLC (“Spain at Home”, 3200 NW 62nd Ave, Unit #1001, Margate, FL 33063) and you, the person who joins as a partner (“Partner”). You accept it the first time you open your partner dashboard.

1. What the program is. You recommend Spain at Home products to people you know or to your audience. When a new customer places their first order through your link or your code, you earn a commission.

2. Your link and your code. You get a personal link (spainathome.com/?ref=your-username) and a code that gives your customer 5% off, one use per customer. The link sets a 30-day cookie and the last click wins. If a customer uses your code, the code takes priority over the link.

3. Commission. It is calculated on the product price paid, excluding shipping and taxes, and only on the first order of each new customer.

4. Levels. You move up when your accumulated attributed sales reach one of these marks: Silver, $1,000 or 5 orders of at least $500; Gold, $3,000 or 15 orders of at least $1,500; Ambassador, $7,500 or 30 orders of at least $3,000. We review levels on the 1st of each month.

5. No commission. Some products pay no commission and do not accept the partner code: Arroyabe tuna 900 g, Lukan canned goods, La Catedral piquillo peppers, roscón de Reyes and ensaimada.

6. Your own purchases. No commission on orders you place yourself or from your own account.

7. Payment. We pay on the 1st of each month for sales delivered more than 14 days earlier, once you have accumulated at least $25. Payments go through Stripe. To receive them you must provide your name, address, SSN or EIN, and a bank account. If you earn more than $2,000 in a year, Stripe issues you a 1099-NEC. You are responsible for your own taxes.

8. Returns and cancellations. If an order is returned, refunded or cancelled, the commission for that order is cancelled. If it was already paid, we may deduct it from future payments.

9. Your dashboard. You can see your sales, level and payments at spainathome.com/partners/. You sign in with a code we send to your email, no password. You can also open it from the store app.

10. Honest content. Be truthful and clear. When you share your link or code in a post, video or story, say you are a partner (for example #ad or #partner), as the US Federal Trade Commission asks. Only say what is true about the products.

11. What is not allowed.

• Bidding in paid ads on the “Spain at Home” brand or our domains.
• Posting your code on coupon websites.
• Spam: unsolicited mass messages, fake accounts or misleading posts.
• Promising what the store does not promise, such as 24-hour delivery or guarantees.
• Speaking on behalf of the company or presenting yourself as an employee.
• Using the word “prosciutto” in public content.

12. Independent contractor. You are an independent contractor, not an employee, agent or partner in the legal sense. You decide how and when you work. You pay your own taxes and expenses. You cannot sign contracts or make commitments in our name.

13. Brand and materials. We let you use our product photos and texts from the partner kit only to promote the program. You get no other rights over the Spain at Home name or logo.

14. Changes. We may update commission rates, levels or these terms. We will tell you by email at least 30 days before. Changes do not affect commissions already earned.

15. Closing the account. We may close your account right away if you break this agreement. Either of us may end it at any time with notice by email. Legitimate pending commissions are paid on the next payment date.

16. Liability. We do not guarantee any level of sales or earnings. The program is provided as is, and our liability is limited to the commissions you have earned and not yet been paid.

17. Governing law. This agreement is governed by Florida law. Any dispute will be handled in the courts of Broward County, Florida.
